North Carolina State Criminal Defense

The majority of crimes are prosecuted at the state level. In other words, an offense that violates state laws are typically tried in state courts. Crimes handled by state courts are investigated by local law enforcement officials and state agents. They are prosecuted by state district attorneys or city attorneys.

Here are just a few examples of crimes that are prosecuted in state courts:

  • Theft
  • DUI
  • Burglary
  • Robbery
  • Murder
  • Assault
  • Sex crimes

The severity of the penalty is determined by the seriousness of the offense. Less serious offenses are known as misdemeanors. In North Carolina, there are 4 categories of misdemeanors, with a Class A1 misdemeanor being the most serious, carrying a maximum jail sentence of 150 days and a discretionary fine.

More severe crimes are referred to as felonies. The classification and sentencing schedule for felonies in North Carolina is complex. Similar to misdemeanors, each crime is assigned a class. There are 10 classes of felonies, with a Class A incurring the harshest punishment of life without parole or death.

Federal Criminal Defense

There is a considerable difference between federal and state criminal defense. First of all, crimes at the federal level are investigated by federal officers, including FBI and DEA agents, and they are prosecuted by Assistant U.S. Attorneys. These federal prosecutors have many more resources and often prepare stronger cases.

One of the most significant differences between federal and state cases are the United States Sentencing Guidelines that govern the federal criminal process. These guidelines are extremely complicated and difficult to navigate.

Crimes that fall under federal jurisdiction include, but are not limited to:

  • Crimes that violate federal laws
  • Crimes that involve federal officers or are committed on federal property
  • Crimes that cross state lines
  • Immigration and customs violations
  • Federal tax fraud

Penalties for DWI in NC

In North Carolina, there are 5 levels of penalties for DWI -- the fifth level is the least severe.

  • Level 1: DWI with two gross aggravating factors, or involves a minor passenger

    • Fines: up to $4,000

    • Jail: 30 days to 24 months

  • Level 2: DWI with one gross aggravating factor

    • Fines: up to $2,000

    • Jail: 7 days to 12 months

For the remaining levels, there are no gross aggravating factors and the judge will look at the aggravating and mitigating factors.

  • Level 3:

    • Fines: Up to $1,000

    • Jail: 72 hours to 6 months

  • Level 4:

    • Fines: Up to $500

    • Jail: 48 hours to 120 days

  • Level 5:

    • Fines: Up to $200

    • Jail: 24 hours to 60 days
